The terms on which we sell: authenticity guarantee, ordering, pricing, delivery, duties, returns and liability.

These terms govern your purchase of goods from Her Birkin Bags. Please read them before ordering — placing an order means you accept them.

1. Who we are

Her Birkin Bags is registered in San Diego, California under company number CSDHBB901342027, at 7007 Friars Rd, San Diego, CA 92108, United States. Contact us at sales@herbirkinbags.com or on +1 (614) 547 3596.

2. We are an independent reseller

We are not affiliated with, authorised by, endorsed by or connected to Hermès International, Chanel, Louis Vuitton, or any other brand whose goods we offer. We do not act as an agent for any of them, and nothing on this site should be read as suggesting otherwise.

Brand names, model names and trade marks are used solely to describe genuine second-hand and store-fresh goods that we are offering for resale. All such marks remain the property of their respective owners.

3. Our goods

Every item we sell is genuine. Every item is also unique and, in most cases, pre-owned. That means:

  • Photographs show the actual piece you will receive, not a stock image of the model.
  • Condition is graded against our published scale and described in the listing. Signs of use consistent with the stated grade are not defects.
  • Colour reproduction varies between screens. If exact colour matters to you, ask us before ordering.
  • Once a piece sells, it is gone. We cannot obtain “another one the same”.

4. Authenticity guarantee

We guarantee that every item sold is genuine. If any piece you buy from us is found not to be genuine by a recognised independent authentication service, return it and we will refund you in full, including all shipping and any import charges you incurred. This guarantee is not time-limited.

5. Orders and when the contract is formed

Your order is an offer to buy. Because stock is unique and can be reserved or sold through more than one channel at once, a contract is formed only when we confirm despatch — not when you complete checkout and not when you receive an automated order acknowledgement.

If we cannot fulfil an order — because the piece has sold, because verification checks are not satisfied, or because we cannot lawfully ship to your destination — we will tell you promptly and refund you in full. We will not substitute a different piece without your agreement.

We may require identity verification before despatching higher-value orders.

6. Price and currency

Prices are set and charged in US dollars. Prices displayed in other currencies are an indicative conversion for your convenience only; the amount taken from your payment method will be the US dollar price, and your bank’s own rate and any foreign transaction fee will determine what that costs you.

Obvious pricing errors are not binding. If a piece is listed at a price that is clearly wrong, we will contact you before despatch and you may confirm at the correct price or cancel for a full refund.

7. Delivery, duties and risk

Delivery timescales, our delivered-duty-paid arrangement for the United Kingdom, and the treatment of import charges elsewhere are set out in full on our Shipping Policy, which forms part of these terms.

Risk in the goods passes to you on delivery. Title passes when we have received payment in full. Every shipment is insured for its full value until it is signed for.

Delivery estimates are estimates. We are not liable for delays caused by customs, carriers or events outside our reasonable control, though we will keep you informed and help you chase.

8. Cancellation and returns

You may return any piece within fourteen days of delivery for a full refund of the purchase price. Consumers in the United Kingdom and the European Union have statutory cancellation rights that are at least as favourable, and nothing here limits them.

Where a piece differs materially from its listing, or fails independent authentication, we pay all return costs. Where you have simply changed your mind, return shipping is at your cost and the treatment of any import duty we paid on your behalf is as described on the Returns & Refunds page.

Returned goods must be in the condition in which they were sent, with all inclusions. We may reduce a refund to reflect any diminution in value caused by handling beyond what is necessary to examine the piece.

9. Faulty or misdescribed goods

Nothing in these terms affects your statutory rights in relation to goods that are faulty, not as described, or not fit for purpose. If something is wrong, tell us and we will put it right.

10. Our liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded — including, for consumers, our obligations as to the quality and description of goods.

Subject to that, our total liability arising from any order is limited to the amount you paid for the goods in question. We are not liable for loss of profit, loss of opportunity, or any change in the resale or market value of a piece after you buy it.

Nothing on this site is investment advice. Handbags are not a regulated investment and their resale values move unpredictably.

11. Exotic skins

Pieces in alligator, crocodile, lizard or ostrich are subject to CITES controls. Cross-border movement requires permits, takes additional time, and is not possible to every destination. Where a listing is an exotic skin, we will confirm what is achievable for your country before accepting your order, and will refund in full if the necessary permits cannot be obtained.

12. Your use of this site

All photography, written descriptions and editorial content on this site are our property or used with permission, and may not be copied or reproduced without our written consent.

Please do not scrape, republish or systematically copy our listings.

13. Privacy

How we handle your personal information is set out in our Privacy Policy.

14. Governing law and disputes

These terms are governed by the laws of the State of California, United States, and the courts of San Diego County, California have jurisdiction.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of the country where you live, or of your right to bring proceedings in your local courts.

15. Changes to these terms

We may update these terms. The version in force is the one published when you place your order, and we keep the date of the last change at the top of this page.
