Trade mark notice
Her Birkin Bags is an independent reseller. We are not affiliated with, authorised by, endorsed by, sponsored by, or an official retailer or licensed boutique of Hermès International, Chanel, or any other house whose goods we offer.
HERMÈS, BIRKIN, KELLY, CONSTANCE, CHANEL and all associated names, logos and marks are the property of their respective owners. We use those names solely to identify and describe genuine goods we are offering for resale — a nominative use, and one we take care to keep accurate. Nothing on this website should be read as a claim to own those marks or to speak for their owners.
Pieces sold here are pre-owned or store-fresh goods obtained on the secondary market. They do not carry a manufacturer’s warranty from the original house, and servicing by that house is at its own discretion. Our own Warranty and authenticity guarantee are given by us, and are what stand behind your purchase.
Intellectual property in this site
All content on this website — photography, written descriptions, condition reports, editorial, design and code — is the property of Her Birkin Bags and is protected by copyright. Every product photograph is taken by us, of the actual piece being sold.
You may not copy, reproduce, republish or redistribute any of it for commercial purposes without our written permission. Our photographs and descriptions being lifted onto listings for goods that are not ours is a recurring problem in this trade, and we do pursue it. If you would like to use something, ask us — we usually say yes.
Accuracy of listings
We describe every piece as carefully as we can, photograph wear rather than shooting around it, and grade condition on one published scale. Colour reproduction varies between screens, and leather is a natural material whose grain and tone differ from hide to hide; those variations are not defects.
Where a listing contains an error — including an error in price — we reserve the right to correct it, and to decline or cancel an affected order even after it has been confirmed. If that happens you are refunded in full, immediately. If a piece ever differs materially from its listing, it comes back to us at our cost under the Returns & Refunds Policy.
Protected species and CITES
Alligator, crocodile, lizard and ostrich pieces are covered by the Convention on International Trade in Endangered Species (CITES). Moving them across a border requires permits, those permits take time, and some destinations refuse them outright. We will not ship an exotic without the paperwork that destination requires, and we confirm what is possible for your country before accepting an order rather than after. This occasionally costs us a sale; it is not negotiable.
Customs declarations
Every international parcel is declared accurately and at its full value. We will not under-declare a shipment or describe it as a gift. Under-declaration is customs fraud, it makes the recipient liable as importer, and it voids the transit insurance that would otherwise protect them. Requests to do it are declined, however they are framed.
Anti-money-laundering and identity checks
Higher-value orders may require identity verification before despatch, and we may decline or unwind a transaction where we cannot complete those checks to our satisfaction. Where identity documents are collected they are held only as long as the law requires and are then deleted; the Privacy Policy sets out the retention period. We do not accept cash.
No investment or financial advice
Our Journal discusses how the value of these pieces has moved and what tends to drive it. That is written as background for buyers, not as investment advice, and we are not licensed to give any. Values can fall as well as rise. Buy a piece because you want to own it.
Limitation of liability
To the fullest extent permitted by law, Her Birkin Bags is not liable for indirect, incidental, special, consequential or punitive damages arising from the use of this website or of goods bought through it. Nothing in this notice excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be excluded — and nothing here reduces your statutory rights as a consumer.
Governing law and disputes
These notices and our Terms & Conditions are governed by the laws of the State of California, United States, and the courts of San Diego County, California have jurisdiction. Claims under the Warranty are subject to the separate arbitration agreement set out in that document.
If you are a consumer resident in the United Kingdom or the European Economic Area, this does not deprive you of the protection of the mandatory consumer law of your own country, or of the right to bring proceedings there.
Please raise anything with us first. Most disputes are a misunderstanding that one email resolves, and we would far rather fix a problem than argue about one.
Reporting a problem
- A piece you believe is not authentic — email us and return it for a full refund including return shipping, with no time limit. See Authentication.
- Our photographs or copy used elsewhere without permission — send us the link.
- A site claiming to be us — send us the link. We trade only from herbirkinbags.com and never ask for payment through a third-party messaging account.
- A data-protection concern — see Privacy Policy, which explains how to complain to us and to a regulator.
- An accessibility barrier on this site — tell us what you hit and we will fix it.
Changes to these notices
We update this page when the facts change, and revise the date at the top when we do. The version in force for your order is the one published when the order was placed.
